General terms and conditions

1. Application and approval conditions

1.1 The ordering and sale of products through the webshop “www.sanas.be” is offered to you by:

These general terms and conditions of sale are those of the Seller.

"Buyer" means any natural person who purchases one or more product(s) via the Seller's webshop “www.sanas.be” as well as any visitor to the webshop, and who acts for purposes that fall outside his trade, business, craft or profession.

1.2 These terms and conditions of sale apply to every purchase made by the Buyer through the Seller's webshop "www.sanas.be" or other agreements concluded through the webshop.

1.3 Before the agreement is concluded, the Buyer will be given the opportunity to review the content of these general terms and conditions of sale and expressly accept them. Placing an order through the Seller's webshop is only possible if the Buyer expressly agrees to the content and applicability of these general terms and conditions to the purchase agreement to be concluded. To this end, the Buyer must check the appropriate box marked "Agree to General Terms and Conditions" before completing the order.

1.4 Goods are sold to the Buyer exclusively through the Seller's online store and exclusively in the countries where the Seller operates, as indicated on the online store. Therefore, the Seller may only accept a Buyer's order through the online store if the delivery address is located in one of these countries and this delivery address is not a PO Box.

1.5 If one or more articles of these terms and conditions are declared invalid by a court ruling, the remaining provisions of these terms and conditions of sale will remain in full force. In the event of the invalidity of any provision, the Seller and the Buyer will, to the extent possible and in accordance with their loyalty and convictions, negotiate to replace the invalid provision with an equivalent provision that reflects the general spirit of these general terms and conditions of sale.

2. The offer

2.1 The offer made through the seller's webshop may be changed at any time by the seller. In any case, all offers made by the seller are non-binding and should only be considered an invitation to the buyer to place an order.

2.2 Although the online catalog and e-commerce website are compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding on the Seller. Regarding the accuracy and completeness of the information provided, the Seller is only bound by a best efforts obligation. The Seller is in no way liable for obvious material errors, typographical errors, or printing errors.

2.3 The Seller cannot be held liable for a limited stock of its products or a temporarily impossible delivery.

3. Conclusion of the agreement

3.1 A sales agreement between the Seller and the Buyer will only be concluded after the (potential) Buyer's order is explicitly accepted by the Seller, who will notify the Buyer of this by sending a confirmation letter. If payment is successful, the Seller will notify the Buyer by sending a confirmation letter. The sales agreement will be concluded upon receipt of this confirmation by the Buyer.

3.2 The Seller reserves the right to refuse the order without owing the Buyer any compensation, but subject to reimbursement of any amounts paid. The Seller is also entitled to refuse an order due to a serious shortcoming on the part of the Buyer with regard to orders in which the Buyer is involved.

4. Prices

4.1 The prices of the products are indicated in euros as standard, always including VAT and all other taxes or charges that the Buyer is obliged to pay.

4.2 If delivery, reservation or administrative costs are charged, this will be stated separately.

4.3 The price due is that stated in the confirmation letter from the Seller.

4.4 The Seller reserves the right to correct any typographical errors in the price quote. The Seller is entitled to unilaterally change prices if these price changes are due to objective circumstances such as a change in VAT, taxes, etc. This list of objective circumstances is not exhaustive and is provided for illustrative purposes only. However, products will be invoiced based on the rates in effect at the time the order is accepted.

4.5 If the price is increased, the Buyer has the right to terminate the agreement without incurring any costs. In that case, the Seller is not obligated to pay any damages.

4.6 The products remain the property of the Seller until the price has been paid in full and definitively.

5. Payment

5.1 The Buyer may choose between the following payment methods when ordering goods via the webshop:

  • via credit card
  • via bank card
  • via bank transfer
  • via other payment methods offered by the Seller

When using these payment systems, the Buyer must, of course, also comply with any terms and conditions of the relevant administrators. The Seller is not a party to the relationship between the Buyer and the payment system administrator.

5.2 The Seller undertakes to ensure the safety of the user of the webshop to the best of its ability, but can under no circumstances be held liable for any damage resulting from the use of the webshop and in particular for damage caused by third parties who misuse the website or the payment system.

5.3 The Seller shall respect the rules regarding the reimbursement of amounts paid by the Buyer in accordance with the legal provisions in force and set out in Article 7 of these general terms and conditions.

6. Delivery and delivery times

6.1 The products will be sent to the shipping address specified when ordering (home address or other address) via the webshop and in accordance with the delivery method specified when ordering, and this in accordance with Article 1.4 of these general terms and conditions.

6.2 The delivery times listed on the Seller's webshop are indicative. The Seller undertakes a best-efforts obligation to deliver the products on the date specified in the order.

6.3 Except in cases of force majeure, hardship (as defined in Article 9.2 of these terms and conditions), or other situations beyond the Seller's control, an additional delivery period may be agreed upon between the Buyer and the Seller if the aforementioned best efforts obligation cannot be met. In the absence of an agreement on an additional delivery period, the agreement may be terminated by operation of law. In that case, the Seller will refund any payment received within 30 days. In that case, the Seller will not be liable for any compensation.

7. Right of withdrawal

7.1 The right of withdrawal only applies to purchases made via the webshop by the Buyer.

7.2. The buyer may only return an item within 14 days if: (1) the seal has not been broken or the packaging has not been opened; (2) the product has become defective within the manufacturer’s warranty period; (3) the non-food product is still in its original condition and packaging; (4) the expiration date has not passed; (5) the product is not of a personalized nature (made to the buyer’s specifications). An item cannot be returned if (1) the expiration date has passed; (2) the seal has been broken or a product has already been opened; (3) the non-food product is no longer in its original condition or packaging; (4) the product is of a personalized nature (made to the buyer’s specifications).

7.3 If the right of withdrawal applies, the Buyer has a 14-day withdrawal period to cancel the sale. This withdrawal period begins on the day on which the Buyer or a third party designated by the Buyer acquires physical possession of the product. The Buyer must inform the Seller of their wish to cancel the purchase within this 14-day period in an unambiguous manner, using the withdrawal form.

7.4 Without undue delay and in any event within 14 days from the day on which the Buyer communicates his decision to cancel the purchase, the Buyer shall return the goods or hand them over to the Seller or to a person authorized by the Seller to receive the goods.

The deadline is met if the Buyer has returned the goods before the 14-day period has expired. The Buyer will return the goods to the Seller at their own expense and in the original packaging. For non-food products, all labels must remain attached.

7.5 If the Buyer revokes the agreement in accordance with this article, they will receive all payments made up to that point, excluding delivery costs, without delay and no later than 14 days after the return of the goods. Any additional costs resulting from the Buyer's choice of a delivery method other than the least expensive standard delivery offered by the Seller will not be reimbursed.

The Buyer will be reimbursed using the same means of payment as he used for the initial transaction, unless he has expressly agreed otherwise.

7.6. The buyer is not permitted to exchange a product.

8. Warranty and complaints

8.1 Upon discovering a defect, the Buyer must notify the Seller as soon as possible. In any case, any defect must be reported by the Buyer within 14 days of discovering it. After that, any right to replacement expires. The Buyer must also be able to provide the Seller with proof of purchase.

To exercise his warranty right, the Buyer must contact the Seller in accordance with Article 8.2 and return the goods to the Seller at the Seller's expense.

8.2 To report complaints and/or request a return to the Seller, the Buyer must send an unambiguous letter to the Seller via info@sanas.be , where the following information must be provided:

  • Seller Contact Details;
  • Buyer Contact Details;
  • Original order or invoice number;
  • Item description with lot number and quantities;
  • Clear description of the problem;
  • Photos in JPG file with shooting date, especially detail photo of visible damage.

After internal assessment of the complaint and/or return request, the Buyer will be informed whether or not the complaint and/or return request has been accepted.

8.3. The warranty does not apply to:

Defects which in the Seller's opinion are the result of improper handling, carelessness, neglect, failure to comply with operating instructions or manuals, adjustments or modifications to the goods, or any other abnormal or incorrect use;

Defects resulting from use in an unsuitable environment;

9. Liability

9.1 The Seller's liability shall at all times be limited to the liability that is mandatory by law in the given factual circumstances and shall otherwise be limited to its gross negligence or intentional misconduct and shall in any event be limited to the invoice amount and shall in no event imply indirect or consequential damage.

9.2 No liability and/or obligation is accepted for damage arising as a direct or indirect result of force majeure and/or hardship. A situation of force majeure and/or hardship is understood to include (merely by way of example): production interruptions, supply problems, shortages of raw materials, labour, energy and transport, or delays in transport, currency fluctuations, increases in the prices of materials, prices of auxiliary materials and raw materials, wages, salaries, social security contributions, government-imposed costs, levies and taxes, transport costs, import and export duties or insurance premiums, occurring between the order confirmation and delivery, ice formation, exceptional weather conditions, strikes, lockouts, work stoppages or other collective labour disputes, mobilisation, war, illness, accidents, communication and IT disruptions, government measures, export ban, which affect the Seller itself or its suppliers.

12. Applicable law

12.1 The sale to which these terms and conditions of sale relate is exclusively subject to Belgian law, to the exclusion of the Vienna Sales Convention.

12.2 Disputes between the Buyer and the Seller shall be submitted exclusively to the jurisdiction of the courts of the judicial district of Antwerp, Hasselt division.
